Dear Sarah Kaiser, Head of Equality Human Resources & Administration Brent Council,

Thank you very much for your response.

You wrote:
"Please note that the equality characteristic of race (as defined by the Equality Act 2010) includes ethnic or national origins, colour and nationality."

Yes.
That is correct.
An Ethnicity is a sub-division of a Race.
For example;
The IC3 Black Race is officially divided into three (3) ethnicities which are:
1. B1 Caribbean
2. B2 African
3. B9 Black Other

You wrote:
"The terms 'ethnicity' and 'race' are often used interchangeably on equalities monitoring forms and published equalities information."

1. Please would you explain exactly what you mean by "used interchangeably"?
2. Does Brent Council use Race and Ethnicity interchangeably?
3. Can you show me an example of where Race and Ethnicity are used interchangeably?
4. Are you, Sarah Kaiser, implying that Race and Ethnicity have exactly the same meaning?

You wrote:
"Brent's equality monitoring forms and published equalities data all meet the requirements of the Public Sector Equality Duty."

Sorry.
That does not appear to be correct.

It appears that from the information I am receiving from Brent Council that there is a problem with Race Relations in Brent Council. As a result of the way my request for information has been handled it has caused me to doubt the management of Race Relations in Brent Council.

You, Sarah Kaiser, could be a White Supremacist. There is no way for me to know whether you, Sarah Kaiser, are a White Supremacist unless I ask and observe your response. I cannot afford to take the risk of assuming that you, Sarah Kaiser, are not Racist. That is why I must ask and observe your response. It is very relevant to know if you, Sarah Kaiser, are a Racist when making an inquiry about Race Relations in Brent Council and the way Race Relations impacts the treatment and management of the staff in Brent Council and the people in Brent. Can you understand that?

5. Are you, Sarah Kaiser, a White person? Yes or No?

6. Are you, Sarah Kaiser, a Racist? Yes or No?

Please let me know who in the Brent Council Equalities Department can explain why, it appears that, other Races apart from the Black Race and the White Race are not recognised by Brent Council in relation to the Public Sector Equality Duty (Equality Act 2010) .

I am very concerned that no effort is being made to foster good relations between the European Races and how this could be impacting Race Relations in general in Brent Council.

Kind regards

Derrick Lynch, IC3, B9, BEUR

Dear Derrick Lynch,

Cara Davani, Director of HR & Administration, has asked me to respond to questions 1 and 2 in your email below.

Please note that the equality characteristic of race (as defined by the Equality Act 2010) includes ethnic or national origins, colour and nationality. The terms 'ethnicity' and 'race' are often used interchangeably on equalities monitoring forms and published equalities information.

Therefore, Brent's equality monitoring forms and published equalities data all meet the requirements of the Public Sector Equality Duty.

Your sincerely,

Sarah Kaiser

Dear Cara Davani,

Thank you for your reply.

As far as I am aware the Census does not use categories for "Race". The Census only uses the categories for "Ethnicity".

1. Where exactly do the categories for "Race" appear in the Census data?

2. Where exactly is the data to do with "Race" (not ethnicity) on the Brent Council website?

Sent on behalf of Cara Davani, Director of HR and Administration.

Dear Mr Lynch,

Thank you for your recent enquiry relating to European Race Equality.

Brent Council's equalities monitoring includes the equality characteristic of race, which is defined as referring to a group of people defined by their race, colour, and nationality (including citizenship) ethnic or national origins. We use the same categories for race as the Census, which is produced by the UK government. All of our equalities data is published on Brent Data (
https://intelligence.brent.gov.uk).

If you believe that you have experienced racism, we recommend that you contact the Equality Advisory and Support Service (

Dear Cara Davani, Director of HR and Equalities in Brent Council,

James Scott, the Principal FoI Officer of Brent Council, advised me to contact you with my query.

I fail to see how Brent Council can have "due regard" for Race Relations without having any Racial data.

The Public Sector Equality Duty (Equality Act 2010) requires public authorities to have ‘due regard’ to the need to:

1. Eliminate discrimination, harassment and victimisation and any other conduct that is prohibited by or under the Act.

2. Advance equality of opportunity between people who share a relevant protected characteristic and people who do not share it.

3. Foster good relations between people who share a relevant protected characteristic and those who do not share it.

I am concerned about the management of European Race Relations and not about Ethnicity Relations or Diversity Relations.

Race a Protected Characteristic

As you probably know Race is one of the "Protected Characteristics" in the Equality Act 2010.

Refers to the protected characteristic of Race. It refers to a group of people defined by their race, colour, and nationality (including citizenship) ethnic or national origins.

Note 1: http://www.equalityhumanrights.com/private-and-public-sector-guidance/guidance-all/protected-characteristics

Race as defined by the British Police

Code

Ethnicity

IC1

White - North European / White European

IC2

White - South European / Dark European

IC3

Black

IC4

Asian (in the UK Asian refers to people from the Indian subcontinent like India, Pakistan, Bangladesh, Nepal)

IC5

Chinese, Japanese, or other South East Asian

IC6

Arabic or North African / Middle Eastern

IC9

Race not to be confused with Ethnicity

I have given the link to the Ethnicity Data Standard as specified by the Information Standards Board to make it clear that I am not asking for Ethnicity information.

Failure to manage Race Relations effectively results in the failure to address the problem of Racism.

My Race Relations query

Please would you send me details of where I can find Council information showing that “due regard” has been exercised in recording and monitoring Race Relations between the IC1 White Northern European Race and the IC2 Dark Southern European Race as required by the Public Sector Equality Duty (Equality Act 2010).

_________________________________________________________________

It is very clear that the Police recognise the Racial difference between the IC1 White North European and the IC2 Dark South European Races and record and use this data for legal purposes.

I am very concerned that no effort is being made to achieve European Race Equality.

I look forward to your reply on this very serious issue.

Dear Mr Lynch,

I fear you have misunderstood my response.

Your request was to be directed to a document that demonstrated that the Council fulfilled a certain requirement. In effect, this was a request for the Council to answer whether it had fulfilled that requirement and a challenge to produce evidence to that effect. Whilst that is a perfectly reasonable request to make, it is not a request for a specific document – it is a request for the Council to perform a service on your behalf and express an opinion. Whether the Council has fulfilled that requirement is a matter of opinion, and opinion falls outside of FoIA.

The Freedom of Information Act exists for individuals to request documents and named information, that is already held in recorded form by the Council at the time it was requested. By asking the Council to demonstrate that it has fulfilled a certain requirement you are asking the Council to create new information, and in that way it falls outside the jurisdiction of the Act.

I would re-iterate that the information you are seeking is almost certainly found within the webpages that I linked to you. If it is not, you will be able to find the contact details of the officers who prepared those documents who may be able to assist you further.

Please would you forward my request for this Racial information through to the equalities division of the Council or to a person that will be able to provide a full explanation as to why the Council has neglected to record Racial information, in permanent form, in order to carry out the duty the Council has as required under the Public Sector Equality Duty (Equality Act 2010).

The Police record Racial information in permanent form for Racial and legal purposes. I need a full explanation as to why the Council has failed to record this information for Race Relations purposes under the Public Sector Equality Duty (Equality Act 2010).

The Public Sector Equality Duty (Equality Act 2010) requires public authorities to have ‘due regard’ to the need to:

I am very concerned that no effort is being made to foster good relations between IC1 North Europeans and IC2 South Europeans to achieve European Race Equality. I fear Race Relations as a whole could be suffering from this apparent oversight.

I look forward to your reply on this very serious issue.

Dear Sarah,

Thank you for your reply.

You wrote:

Thank you for this information. It is very useful. I visited http://www.ucl.ac.uk/hr/equalities/race/REG_news.php and watched the video that featured Dr Cecil Thompson, Chair of the UCL Race Equality Group.

I was unable to find any Race Relations information on the University College London website. Please could you let me know exactly where data on Race (not ethnicity) is displayed.

I fail to see how University College London can have "due regard" for Race Relations without having any Racial Data.

I need a full explanation from the correct person in University College London for the apparently missing Racial Data.

It appears that the difference between the IC1, North European Race and the IC2, South European Race, as recognised by the Police, has been overlooked by University College London.

It is possible that there is poor management of relations between the IC1 White North European Race (Caucasoid) and the IC2 Dark South European Race (Melanochroid) and that this dreadful inequality is impacting relations between other Races and causing White Supremacy in the management of University College London which is causing University College London to fail in the Public Sector Equality Duty (Equality Act 2010).

Please will you forward my inquiry to the person responsible for Racial equalities or give me the email address of the same person if you are unwilling to help in that way for Racial reasons.

1. Does the University College London recognise the difference between the IC1, North European Race (Caucasoid) and the IC2, South European Race (Melanochroid) , as recognised by the Police?

The Public Sector Equality Duty (Equality Act 2010)

The Public Sector Equality Duty (Equality Act 2010) requires public authorities to have ‘due regard’ to the need to:

1. Eliminate discrimination, harassment and victimisation and any other conduct that is prohibited by or under the Act.

2. Advance equality of opportunity between people who share a relevant protected characteristic and people who do not share it.

3. Foster good relations between people who share a relevant protected characteristic and those who do not share it.

This is a Freedom of Information Act request.

I am concerned about the management of European Race Relations and not about Ethnicity Relations or Diversity Relations.

As you may know Race is one of the "Protected Characteristics" in the Equality Act 2010.

Race a Protected Characteristic

Refers to the protected characteristic of Race. It refers to a group of people defined by their race, colour, and nationality (including citizenship) ethnic or national origins.

Note 1: http://www.equalityhumanrights.com/private-and-public-sector-guidance/guidance-all/protected-characteristics

Race as defined by the British Police

Code

Ethnicity

IC1

White - North European / White European

IC2

White - South European / Dark European

IC3

Black

IC4

Asian (in the UK Asian refers to people from the Indian subcontinent like India, Pakistan, Bangladesh, Nepal)

IC5

Chinese, Japanese, or other South East Asian

IC6

Race not to be confused with Ethnicity

I have given the link to the Ethnicity Data Standard as specified by the Information Standards Board to make it clear that I am not asking for Ethnicity information.

Failure to manage Race Relations effectively results in the failure to address the problem of Racism.

I understand that BME is short for Black Minority Ethnic. It appears that University College London only recognises the Black and White Races.

3. Does the University College London only recognise the Black and White Races?

It appears that from the information I am receiving from University College London that there is a problem with Race Relations in University College London. As a result of the way my request for information has been handled it has caused me to doubt the management of Race Relations in University College London.

You, Sarah, could be a White Supremacist. There is no way for me to know whether you, Sarah, are a White Supremacist unless I ask and observe your response. I cannot afford to take the risk of assuming that you, Sarah, are not Racist. That is why I must ask and observe your response. It is very relevant to know if you, Sarah, are a Racist when making an inquiry about Race Relations in University College London and the way Race Relations impacts the treatment and management of the people in University College London. Can you understand that?

5. Are you, Sarah, a White person? Yes or No?

6. Are you, Sarah, a Racist? Yes or No?

Please let me know who in the University College London Equalities Department can explain why, it appears that, other Races apart from Black and White are not recognised by University College London in relation to the Public Sector Equality Duty (Equality Act 2010) .

I am very concerned that no effort is being made to foster good relations between the European Races and how this could be impacting Race Relations in general in University College London.

Kind regards

Dear Derrick,

Thank you for your email.

Our equal opportunities policy is here http://www.ucl.ac.uk/hr/docs/equal_opportunity.php and we have some useful information about our race equality projects and groups here http://www.ucl.ac.uk/hr/equalities/race/index.php

UCL has recently take part in the Race Equality Charter Mark: http://www.ecu.ac.uk/equality-charters/race-equality-charter-mark/ and we’ll be publishing it once it’s been judged, later in the year.

You might also like to look at our staff data (including by ethnicity) which is readily available online: http://www.ucl.ac.uk/hr/statistics/ and our student data: https://www.ucl.ac.uk/srs/statistics

I hope this answers your question.

Best wishes,

Sarah

Subject: UCL RACE RELATIONS - RUMOURS

Dear Aian Guled,

Thank you for your reply.

To whom it may concern at the UCL, (please forward to equalities representative)

I am Derrick Lynch and I have heard some disturbing news about the UCL.

I also was given this article:

Black academic claims he was denied university job over his plans to 'put white hegemony under the microscope'

http://www.independent.co.uk/news/uk/home-news/black-academic-claims-he-was-denied-university-job-over-his-plans-to-put-white-hegemony-under-the-microscope-10270949.html

I prefer not to go by rumours so I have decided to make some inquiries for myself and my community.

I live at 5 Hedge Hill, Enfield, London, EN2 8RU.

I am classified, by the British Government, as an IC3, Black, Male.

I have attached illustrated versions of the Race and Ethnicity Codes as used by the British Police and Civil Services.

I am a victim of Racism which I understand as being the same as White Supremacy.

I have been reading the UCL website.

Please could you send me:

1. The UCL Race Relations Policy.

2. A UCL report on how the Race Relations Policy has been performing to date.

3. Details of how the UCL manages and monitors Race Relations.

Kind regards

Derrick Lynch, IC3, B9, BEUR
