Dear Derrick,

I have now spoken to all known witnesses and reviewed your own statement that you made to police. There is insufficient evidence to proceed with an allegation of racially aggravated common assault. To prove a case of common assault the charging guidelines state 'A battery is an intentional or reckless act whereby unlawful force is inflicted. A mere touch can amount to battery;' After speaking to the witnesses they state that the contact was a touch in order to get your attention during your discussion with The Enterprise manager.

I understand this may not be the outcome you were hoping for but the police can not proceed with this matter as a criminal investigation.
