The s.149 duty in the Equality Act 2010 requires a public authority in the carrying out of all its functions to have due regard to the need to eliminate discrimination, to advance equality of opportunity and to foster good relations across the protected characteristics.

Organisations that are not "public authorities" are also required to have due regard to the need to eliminate discrimination, to advance equality of opportunity and to foster good relations across the protected characteristics whenever they carry out "public functions".

The six (6) protected racial characteristics as used by the Metropolitan Police will be used for Racial Clarity.

IC6 Arab

White Supremacist Racist decision making does not eliminate discrimination, advance equality of opportunity or foster good relations across the protected characteristics as specified in the s.149 duty in the Equality Act 2010.

1. Does the Hertfordshire Library Services have a well managed, effective and transparent Racial Equality Strategy?
2. Please send us a copy of the minutes where Racial Equality in the Hertfordshire Library Services was last discussed.

Your request for information has been considered under the Freedom of Information Act 2000. I can confirm that Hertfordshire County Council does hold the information you have requested, and can respond as follows:

Please note following the enactment of the Equalities Act 2010 Hertfordshire County Council now publishes a single Equality Strategy rather than separate ones for  race, disability and gender. The link to this can be found on our website at:
Individual departments and services then produce an Equalities Action Plan.

1. Please find attached a copy of the Libraries, Culture & Learning Equalities Action Plan  2011/13.

2. The Libraries, Culture and Learning Equalities Plan is reviewed and updated every quarter at meetings of the Library Board. Minutes of the December 2011 meeting are attached, the review is item 6 within the minutes.

Please note we have redacted a small amount of text from item 8 because after careful consideration the County Council has decided that this information should be withheld under the exemption contained in Section 40(2) of the Freedom of Information Act 2000, relating to third party personal data.  The disclosure of this information would contravene the first Data Protection principle as individual has not provided their consent for the information to be disclosed.
