Dear Cara Davani, Director of HR and Equalities in Brent Council,


James Scott, the Principal FoI Officer of Brent Council, advised me to contact you with my query.


I fail to see how Brent Council can have "due regard" for Race Relations without having any Racial data.




The Public Sector Equality Duty (Equality Act 2010) requires public authorities to have ‘due regard’ to the need to:

1. Eliminate discrimination, harassment and victimisation and any other conduct that is prohibited by or under the Act.

2. Advance equality of opportunity between people who share a relevant protected characteristic and people who do not share it.

3. Foster good relations between people who share a relevant protected characteristic and those who do not share it.




I am concerned about the management of European Race Relations and not about Ethnicity Relations or Diversity Relations.




Race a Protected Characteristic

As you probably know Race is one of the "Protected Characteristics" in the Equality Act 2010.

Refers to the protected characteristic of Race. It refers to a group of people defined by their race, colour, and nationality (including citizenship) ethnic or national origins.

Race not to be confused with Ethnicity

I have given the link to the Ethnicity Data Standard as specified by the Information Standards Board to make it clear that I am not asking for Ethnicity information.

Failure to manage Race Relations effectively results in the failure to address the problem of Racism.

My Race Relations query




Please would you send me details of where I can find Council information showing that “due regard” has been exercised in recording and monitoring Race Relations between the IC1 White Northern European Race and the IC2 Dark Southern European Race as required by the Public Sector Equality Duty (Equality Act 2010).

It is very clear that the Police recognise the Racial difference between the IC1 White North European and the IC2 Dark South European Races and record and use this data for legal purposes.

I am very concerned that no effort is being made to achieve European Race Equality.

I look forward to your reply on this very serious issue.

Dear Mr Lynch,



I fear you have misunderstood my response.



Your request was to be directed to a document that demonstrated that the Council fulfilled a certain requirement. In effect, this was a request for the Council to answer whether it had fulfilled that requirement and a challenge to produce evidence to that effect. Whilst that is a perfectly reasonable request to make, it is not a request for a specific document – it is a request for the Council to perform a service on your behalf and express an opinion. Whether the Council has fulfilled that requirement is a matter of opinion, and opinion falls outside of FoIA.



The Freedom of Information Act exists for individuals to request documents and named information, that is already held in recorded form by the Council at the time it was requested. By asking the Council to demonstrate that it has fulfilled a certain requirement you are asking the Council to create new information, and in that way it falls outside the jurisdiction of the Act.



I would re-iterate that the information you are seeking is almost certainly found within the webpages that I linked to you. If it is not, you will be able to find the contact details of the officers who prepared those documents who may be able to assist you further.

Please would you forward my request for this Racial information through to the equalities division of the Council or to a person that will be able to provide a full explanation as to why the Council has neglected to record Racial information, in permanent form, in order to carry out the duty the Council has as required under the Public Sector Equality Duty (Equality Act 2010).



The Police record Racial information in permanent form for Racial and legal purposes. I need a full explanation as to why the Council has failed to record this information for Race Relations purposes under the Public Sector Equality Duty (Equality Act 2010).

I am very concerned that no effort is being made to foster good relations between IC1 North Europeans and IC2 South Europeans to achieve European Race Equality. I fear Race Relations as a whole could be suffering from this apparent oversight.
