Dear Anna Mcmaster, Executive Officer (Partnerships),
Paul Burns recommended I contact you with regard to the apparent European Race Relations problem in Leeds City Council. It appears that Paul Burns is gravely mistaken in his views and might be misrepresenting Leeds City Council in his views.
Does Leeds City Council recognise the Racial difference between the IC1 White North European Race (Caucasoid) and the IC2 Dark South European Race (Melanochroid) and record and use this data for Race Relations purposes in relation to the Public Sector Equality Duty (Equality Act 2010)?
I am very concerned that no effort is being made to foster good relations between the European Races and how this could be impacting Race Relations in general in Leeds City.
I look forward to your reply on this very serious issue.

Of course, the protected characteristic of Race is related to the performance of an individual employee if that employee is working in a Racist organisation.
It appears that from the information I am receiving from you, Paul Burns, that there is a serious problem with Race Relations in Leeds City Council and that there is a clear public interest in members of the public knowing this. As a result of the way my request for information has been handled it has caused me to doubt the management of Race Relations in Leeds City Council.
You, Paul Burns, could be a White Supremacist. There is no way for me to know whether you, Paul Burns, are a White Supremacist unless I ask you and observe. I cannot afford to take the risk of assuming that you, Paul Burns, are not a Racist. That is why I must ask and observe your response. It is very relevant to know if you, Paul Burns, are a Racist when making an inquiry about Race Relations in Leeds City Council and the way Race Relations impacts the management of the people in Leeds City. Can you understand that?
1. Are you, Paul Burns, a White person? Yes or No?
2. Are you, Paul Burns, a Racist? Yes or No?

I hope Anne Mcmaster in the Leeds City Council can explain why these Races are not recognised by Leeds City Council in relation to the Public Sector Equality Duty (Equality Act 2010).

I refer to the above, your request dated 20/05/2015 and the council’s response dated 01/06/2015.
I note from your email below that you have requested further information in regards to Mr Aziz, however it is not clear from your email what other recorded information you are requesting that you believe the council’s is holding under the Freedom of Information Act 2000 (the Act).
In regards to your general enquiries regarding race relations in the council, I would recommend that you contact Anne McMaster, Executive Officer (Partnerships), Anne.Mcmaster@leeds.gov.uk, please note that Anne McMaster will only be able to respond to general enquires and not to requests under the Act.
I now turn to your request regarding the protected characteristics as defined by the Equality Act 2010 relating to Mr Aziz.
In accordance with Section 40 of the Act, personal data of third parties is exempt if disclosure would breach one of the data protection principles. Thus, the first step is to ascertain whether the requested information constitutes personal data.
Section 40(7) of the Act confirms that the relevant definition is set out in section 1(1) of the Data Protection Act 1998 (the DP Act): “personal data” means data which relate to a living individual who can be identified. Information about the protected characteristics as defined by the Equality Act 2010 would enable you to identify an individual, and in this case, it is clear that your are requesting information about a named individual, therefore I am satisfied that the information you have requested is personal data.
I consider that the first condition, set out in Section 40(3) is satisfied in that disclosure to the public otherwise than under the Act would contravene one of the data protection principles, namely the first principle that personal data must be processed fairly and lawfully.
I do not accept there is a clear public interest in members of the public knowing the protected characteristics of a named employee and consider that this information is not related to an individual employee’s performance and has no bearing on their duties, therefore we must treat this information as exempt under Section 40 of the Act..
